Speaking at an event hosted by SACSIS and the Friedrich Ebert Foundation (FES) to examine the impact of traditional leadership on rural land reform, Nomboniso Gasa, posited that there’s a new form of dispossession taking place in South Africa, as untapped mineral resources influence a new round of land claims by the rural elite. Communal land rights and collective benefits for the rural poor are being sacrificed as a feudal and patriarchal system of governance, sustained in the name of heritage, is expanding the authority of chiefs over valuable tracts of land. This quest for land and mineral rights by traditional authorities is motivated by deposits of platinum in the North West, unexplored coal in KZN and titanium on the Wild Coast, argued Gasa. About Nomboniso Gasa: Nomboniso Gasa is a researcher, analyst and public speaker on gender, politics and culture. She weaves together her academic background, lived experience and constant engagement with contemporary and historical South African issues. Her work is in scholarly journals, in local and international print, electronic and audio-visual media. She has featured in international documentaries. She is a Senior Research Associate at the Centre for Law and Society, Faculty of Law, University of Cape Town. Her focus is on the intersection of land, living custom, the construction of identities and Traditional Leadership.

http://www.3fatallandbuyingmistakes.com Hi, Mark the LandGeek here. Let's talk about those 3 fatal mistakes that I see the average real estate investor making every single day. First big mistake -- you've got to call the county recorder and confirm that that seller owns the property. So what do you do? First of all, you find out exactly what county that property is located in. Then you quickly go on at naco.org, and it's www.naco.org. That lists all the counties in the country. Do a quick search. You can do with the state, you can do the county -- whatever you want to do, but make sure you go there. Then all you need to do is if you don't want to talk on the phone, you can email the recorder and simply ask who owns this property at this legal description. They will email you back where they'll tell you it's Frontier Equity Properties LLC. When was it recorded? And that gives you a big clue as to how long did that seller own that property. Are they buying it for long-term? Are they flipping it? What's going on with that property? It kind of gives you a little bit more in the story anyways. So now you've got that information. Again, email our seller now and say, "Hey, can you fax me or email me a copy of your recorded deed for that property?" When they do it, we get to go, to take some time, a little sketchy. If they don't do it at all, don't buy the property. What I have seen is people go online and they can just easily copy now whatever ad is online and say, "Hey, that's my property". They can use a fake PayPal account or a fake Escrow account and take people's money. The typical term for this is a 'phishing' scam. That is the number one fatal mistake that I see people make. You've got to confirm that that seller owns that property; otherwise, who knows what you are getting into. Now there are situations where I have actually sold property on an auction and that's a whole other ballgame because I am just controlling that. If that's the case, then you need to have a copy of the auction agreement to see that they are controlling that property. Otherwise, look out - not a good thing at all! All right, second most fatal mistake I see the average real estate investor making online is they get really excited about the property. They are going to build their dream home there or they are going to put their RV on the property. They are just going to camp out and hang out six months out of the year, or they are going to raise sheep, they are going to do something cool on that property. But they don't confirm with the County Planning and Zoning Commission if what their use for that property is allowed. And so they will invest thousands of dollars, ultimately to be disappointed, and 99.9% of the sellers out there, they don't guarantee that property. You are stuck with it and now whatever dream you had to do on that property is wasted, and then you've got to go on and try to resell that property and so whole hassle and just a big bar of disappointment. So, what do you do? Like we did with the first mistake, we've got to contact the County Planning & Zoning Commission. We are going to go back to our website www.naco.org. We are going to find our county and we are going to call or email planning and zoning. We are going to give them the legal description of that property along with the assessor's parcel number and we are just going to ask the questions -- what restrictions are on this property? What can I do on this property? Can I build a house? Can I raise sheep? Can I camp? Can I put my RV? All these things are very important when trying to determine that your use for that property is allowed. So it's very, very important that you do that. The third most common fatal mistake I see buyers making every day and being really, really disappointing with their purchase, is not calling the County Treasurer to confirm that the taxes are paid current. This one is really something that I have seen time and time again, bite people on the tush. So it's really important that again, we are going to go back to our site www.naco.org -- N-A-C-O, we are going to find our County Treasurer, then we are going to shoot them an email -- again, with the legal description and assessor's parcel number and that information you should be able to get from your seller very easily and it should be on the ad. If it's not, you need to email your seller and get that information. And then you are simply going to confirm the taxes are paid current. If they are not paid current, you need to email your seller and ask them, "Who is responsible for these back taxes? I assume you are." If they say, "Oh, you are responsible for those back taxes", then you've got a decision to make. Well, how much are they if their owner is going to pass on that deal? If they are reasonable and you are getting at a good price, well, maybe pay the back taxes -- big deal. http://www.3FatalLandBuyingMistakes.com

Indigenous Barngarla Australians win land claim

Australia's indigenous Barngarla people have won a campaign, lasting nearly 20 years, for the law to recognise their right to traditional lands. The native title claim over a huge tract of land in South Australia has been mostly upheld by a federal court. Native titles are pre-colonial rights held by Australia's indigenous people, derived from their laws and customs. The Barngarla people traditionally lived along the north-western shore of the Spencer Gulf in South Australia. They lodged their claim for the land in 1996. Stakeholders involved in the claim included the Commonwealth government, commercial fishers, mining companies and pastoralists. The title does not grant freehold to the Barngarla but it means groups such as mining companies must now negotiate with the Barngarla over proposed developments. The claim covered 44,481 square km (1m acres), including about two-thirds of the Eyre Peninsula. The Federal Court's Justice John Mansfield upheld most of the claim but excluded the town of Port Augusta, the coastal waters below Port Lincoln and the islands of the Spencer Gulf. Barngarla elder Eric Paige, present at the court when the judgement was handed down, said the ruling was a step in the right direction. "I'm really happy," he said, according to local media. "We're going to be getting our country back you know, so that's good." 'Bundle of rights' The judgement was particularly significant because the area is densely populated, said South Australian Native Title Service Chief Executive Officer Keith Thomas. "It is important to create some certainty for the Barngarla people about their economic aspirations," Mr Thomas told the BBC. "They don't own any of the land but they have a bundle of rights that allow them to partake in traditional activities such as hunting, gathering, using bush medicine and protecting sacred sites," said Mr Thomas. The issue of whether the native title rights have been subsequently extinguished by other land titles such as freehold title will be determined in a subsequent hearing. Australia's biggest native title claim - covering 14.6m hectares of land and waters - was lodged in a Brisbane court in December. The claim - filed on behalf of nine traditional owners - refers to much of the Cape York Peninsula in the far north of Queensland. Under that claim, any land development will require consent from the owners.

The states fear they may be forced to close up to 210 communities because they will not be able to afford municipal services if the federal government cuts $90 million in funding to Western Australia and $10m to South Australia. Professor Williams, from the University of NSW’s law school, said that, under the constitution, aboriginal people were powerless and had no rights except where native title existed. In this case, ­native title was not under threat. “The constitution was drafted to deny aboriginal people their rights and not vindicate them. It was a racist power to deny them their rights,” Professor Williams said. The Aboriginal Legal Rights Movement said it would investigate any legal avenues to prevent centres from closing. Professor Williams said, given there was no mention of aboriginal people in the constitution, he could not see what they could challenge, leaving them powerless from being moved from their lands. He said they would not be able to claim any compensation if their communities were closed down — or they could choose to live without any services. West Australian Premier Colin Barnett accepted the one-off $90m payment from the federal government to take over responsibility for municipal and essential services, but has conceded that a dearth in funding could force community closures. South Australian Aboriginal Affairs Minister Ian Hunter said that up to 4000 people would be affected across the Anangu Pitjantjatjara Yankunytjatjara Lands. “Prime Minister Abbott claims to be the prime minister for indige­nous peoples, but his government is unilaterally walking away from this responsibility and will literally be turning the lights out as they go,” Mr Hunter said. They took their name (adding an "m") from the location of a German tragedy where 80 people were injured and killed as the result of a crash during an American Air Force air show. The literal translation of "Ram Stein" is a battering ram made of stone. Word of Rammstein's horror/romanticist blend of theater and music - spread quickly - one-time Olympic swimmer Till Lindemann would sometimes sing entire songs engulfed in flame from head to toe. The band's first album, HERZELEID (English: Heartache), elaborated on the foundations set by the band's live reputation. Aquino III stated the historical and cultural importance of Filipino indigenous peoples during the 15th anniversary of the passage of the Indigenous Peoples Rights Act (IPRA) at the GSIS Theater in Pasay City. "Nagtitipon tayo, hindi lang para magbalik-tanaw sa mga tagumpay na ibinunga R.A. 8371. Narito tayo upang higit pang paigtingin ang ating dedikasyon sa paglinang at pagbibigay-lakas sa ating mga katutubo bilang mahalagang bahagi ng ating kultura't lipunan," the President said. He mentioned that his administration aims to provide programs which will promote equal rights and opportunity among the members of indigenous groups including the signing of Executive Order No. 11. It granted the relocation of the National Commission of Indigenous Peoples (NCIP) office from the Department of Environment and Natural Resources to the Office of the President. In such way, the needs, aspirations as well as complaints of the native groups are easily addressed by the government. The President also said that the P20 million allotted yearly for the delineation of ancestral domain has resulted to the titling of 300,000 land hectares. He stated that as of year 2012, 158 certificates of ancestral domain titles are distributed to almost one million claimants. This number includes the release of two certificates of ancestral domain titles (CADTs) and four certificates of ancestral land titles (CALTs) to Pangalawang Pundador Rodolfo Aguilar and Paula Langguyod, Panlima Amparay Das and Panlima Angelito Sanukay, heirs of Elizabeth Mat-an, Lydia Bidos, Dominador Galian and Virginia Cuyan-Panganiban during the event. President Aquino also led the distribution of plaques of recognition to individuals and organizations that helped in the passage of IPRA. The awardees include former congressmen Jeremias Zapata and William Claver, former senator Juan Flavier, former ambassador Howard Dee, the Commission on Human Rights, Gazton Z. Ortigas Peace Institute, Interim National Indigenous Peoples Council and his mother, former president Corazon Aquino. Mylinar Ligligen, Edmar Fronda and Krichelle Mei Cariño are three of the one hundred indigenous students who were awarded in the ceremony with the merit-based scholarship worth P25,000 per semester. Speaking at an event hosted by SACSIS and the Friedrich Ebert Foundation (FES) to examine the impact of traditional leadership on rural land reform, land expert, Prof. Ben Cousins of the Institute for Poverty, Land and Agrarian Studies at the University of Western Cape (PLAAS) contended that traditional leaders enter into deals with mining companies in the name of the community, but these deals are often private. The chiefs and their immediate family members benefit most from the deals with the broader community gaining few benefits. He said that this is happening beyond mining in other areas such as tourism, agriculture and property development. For example, the Bakgatla-Ba-Kgafela chief, Nyalala Pilane, is developing a R300m shopping mall using money that he has gained from platinum royalties. Cousins argued that the land grab by traditional leaders is taking place with the connivance of government. Cousins called for a new hybridised form of communal land ownership where custom would not be rejected, but made compatible with modern institutions -- and quite importantly where women would have equal rights. About Ben Cousins: Professor Ben Cousins holds a DST/NRF Chair in Poverty, Land and Agrarian Studies (PLAAS) at the University of the Western Cape. He holds a DPhil from the University of Zimbabwe, and was in exile between 1972 and 1991. His interests are land and agrarian reform, common property regimes, livestock production and smallholder agriculture.

Luis Evelis Andrade is the Chief Counsellor of the National Indigenous Organization of Colombia (ONIC). The Colombian Constitutional Court has concluded that at least one-third of the 102 distinct Indigenous nations in Colombia face the imminent risk of total annihilation as the consequence of forced displacement from their lands. ONIC is campaigning for enforcement of the protective measures ordered by the Court and respect for the right of free, prior and informed consent as affirmed in the UN Declaration on the Rights of Indigenous Peoples. Anne Marie Sam is an Indigenous woman from the Nak'azdli First Nation in central British Colombia. Her family has lost access to their traditional lands because of the construction of a large open pit mine, the first new mine to enter construction in BC in more than a decade. The states fear they may be forced to close up to 210 communities because they will not be able to afford municipal services if the federal government cuts $90 million in funding to Western Australia and $10m to South Australia. Professor Williams, from the University of NSW’s law school, said that, under the constitution, aboriginal people were powerless and had no rights except where native title existed. In this case, ­native title was not under threat. “The constitution was drafted to deny aboriginal people their rights and not vindicate them. It was a racist power to deny them their rights,” Professor Williams said. The Aboriginal Legal Rights Movement said it would investigate any legal avenues to prevent centres from closing. Professor Williams said, given there was no mention of aboriginal people in the constitution, he could not see what they could challenge, leaving them powerless from being moved from their lands. He said they would not be able to claim any compensation if their communities were closed down — or they could choose to live without any services. West Australian Premier Colin Barnett accepted the one-off $90m payment from the federal government to take over responsibility for municipal and essential services, but has conceded that a dearth in funding could force community closures. South Australian Aboriginal Affairs Minister Ian Hunter said that up to 4000 people would be affected across the Anangu Pitjantjatjara Yankunytjatjara Lands. “Prime Minister Abbott claims to be the prime minister for indige­nous peoples, but his government is unilaterally walking away from this responsibility and will literally be turning the lights out as they go,” Mr Hunter said. 50 Years of the Aboriginal Lands Trust

In 1966 the South Australian Government passed an historic piece of legislation, the Aboriginal Lands Trust Act 1966. The legislation recognised the connection of Aboriginal people to the land and waters and the need to redress dispossession. It ended years of protest rallies and political lobbying. It was the first ever Act in Australia to recognise Aboriginal land rights. In 2016, the Aboriginal Lands Trust continues to be a unique land-holding body. The work it does is as diverse as the property portfolio. The ALT holds the title to the land granted to Aboriginal people. That land is inalienable, it can not be bought, sold, traded or given away. This land is ours.

In this MOA, UGP recognizes the First Nation's Native Title over their Ancestral Domain defining its socio-political and economic-ecological implications.

It originated from the merger of two workers' rights organizations, the Agricultural Workers Organizing Committee (AWOC) led by Filipino organizer Larry Itliong, and the National Farm Workers Association (NFWA) led by César Chávez. They became allied and transformed from workers' rights organizations into a union as a result of a series of strikes in 1965, when the mostly Filipino farmworkers of the AWOC in Delano, California initiated a grape strike, and the NFWA went on strike in support. As a result of the commonality in goals and methods, the NFWA and the AWOC formed the United Farm Workers Organizing Committee on August 22, 1966. This organization was accepted into the AFL-CIO in 1972 and changed its name to the United Farmworkers Union... Dolores Huerta grew up in Stockton, California, which was in the San Joaquin Valley, an area filled with farms. In the early 1950s, she completed a degree at Delta Community College, part of the University of the Pacific. She briefly worked as an elementary school teacher. Huerta saw that her students, many of them children of farm workers, were living in poverty without enough food to eat or other basic necessities. To help, she became one of the founders of the Stockton chapter of the Community Service Organization (CSO). The CSO worked to improve social and economic conditions for farm workers and to fight discrimination. By 1959, César Chávez had already established professional relationships with local community organizations that aimed to empower the working class population by encouraging them to become more politically active. In 1952, Chávez met Fred Ross who was a community organizer working on behalf of the Community Service Organization. This was a group which was affiliated with the Industrial Areas Foundation which was headed by Saul Alinsky. To further her cause, Huerta created the Agricultural Workers Association (AWA) in 1960... In 1962, she co-founded a workers' union with César Chávez, which was later known as the United Farm Workers (UFW). The two made a great team. Chávez was the dynamic leader and speaker and Huerta was a skilled organizer and tough negotiator. Huerta was instrumental in the union's many successes, including the strikes against California grape growers in the 1960s and 1970s... Although still in its infant stages, the organization lent its support to a strike by workers in the rose industry in 1965. This initial protest by the young organization resulted in a failed attempt to strike against the rose industry. That same year the farm workers who worked in the Delano fields of California wanted to strike against the growers in response to the grower’s refusal to raise wages from $1.20 to $1.40 an hour, and they sought out Chávez and the National Farm Workers Association for support. The Delano agricultural workers were majority Filipino workers who were affiliated with the Agricultural Workers Organizing Committee which was a charter of the American Federation of Labor and Congress of Industrial Organizations. The unification of these two organizations, in an attempt to boycott table grapes which were grown in the Delano fields, resulted in the creation of the United Farm Workers of America...

Joan Kuyek on the company behind the Sisson mine April 25, 2018 at Conserver House, Fredericton Larry Wuest of Greenhill outlined crucial questions that remained unanswered about the Sisson project, a huge open-pit tungsten and molybdenum mine and tailings dam proposed to be built on the headwaters Nashwaak watershed. Joan Kuyek shared results of her investigation of the Hunter Dickinson company, the company behind HDI Northcliff Sisson mine. Lawrence Wuest is an ecologist and sculptor from Greenhill, a small community in the Upper Nashwaak watershed, about 15 km from the proposed Sisson mine. He has participated in environmental research since 1975, with numerous scholarly contributions. Joan Kuyek is a mining analyst, writer, researcher and educator living in Ottawa. She was the founding National Coordinator of MiningWatch Canada from 1999-2009. Before that, she lived and worked in Sudbury Ontario, Canada’s largest mining community. She has taught courses on mining law and policy at Queen’s University Law School and on community development and social change at Carleton University. Mining Analyst (in BC for New Prosperity Mine, Chemis North Mine, Raven Coal Mine, in Alaska for the Pebble Mine, in Ontario for the Ring of Fire Project.
