Cabinet has approved a policy for all sand miners will be required to first acquire licenses before extracting sand. The Minister for ICT and National Guidance Frank Tumwebaze told journalists at the Media Center in Kampala, that sand is now categorized as a mineral. This video abstract is based on the paper, "Who Regulates It? Water Policy and Hydraulic Fracturing in Texas" by Margaret Cook, Karen L. Huber and Michael E. Webber as published in the Texas Water Journal, Vol 6, No 1 (April, 2015). Abstract: Hydraulic fracturing, the injection of a pressurized fluid mixture of mostly water, sand and a small amount of chemicals (frac fluids), increases extraction rates and recovery of oil or gas. The technique has become increasingly popular when used in combination with horizontal drilling, especially in Texas shale formations. Hydraulic fracturing often requires thousands of cubic meters of water per well. Access to water might be challenging due to water scarcity, allocation policies, price, location, and competition for water. In this policy analysis, we conducted a detailed bottom-up survey for each groundwater conservation district to catalog and assess the prevailing policies and practices related to water and hydraulic fracturing, focusing on the ways in which the State of Texas regulates the use of fresh and non-freshwater for hydraulic fracturing. We find that policies are inconsistent statewide with great variability from district to district in regulations and potential solutions to the challenge of freshwater use. From this analysis, we provide information on the practice of hydraulic fracturing and examine strategies for reducing freshwater use through recycling and use of non-freshwater. In this report, we present the current water policy framework and alternative solutions.

The word Fracking has become an everyday term, with the growth of the new technology for extracting oil and gas. It is shorthand for hydraulic fracturing and refers to how the rock is fractured apart by the high pressure mixture. Experts also refer to a "frac job" and a "frac unit”. The process has also become very controversial, and the process has made the US a global exporter of energy products shifting reliance from OPEC nations. Fracking refers to the procedure of creating fractures in rocks and rock formations by injecting fluid into cracks to force them further open. The larger fissures allow more oil and gas to flow out of the formation and into the wellbore, from where it can be extracted. Fracking has resulted in many oil and gas wells attaining a state of economic viability, due to the level of extraction that can be reached. Fracking is the process of drilling down into the earth then a high-pressure water mixture is directed at the rock to release the gas inside. Water, sand and chemicals are injected into the rock at high pressure which allows the gas to flow out to the head of the well. The process is carried out vertically or, more commonly, by drilling horizontally to the rock layer. The process can create new pathways to release gas or can be used to extend existing channels. The company operates deep mines as well as strip mines. Most of the coal mined is sold under contract, with excess production sold on the spot market. The coal mining industry, especially high-sulfur coal operations such as Bethesda, has been hard hit by environmental regulations. Recently, however, a combination of increased demand for coal and new pollution reduction technologies has led to an improved market demand for high sulfur coal. Bethesda has just been approached by Mid-Ohio Electric Company with a request to supply coal for its electric generators for the next four years. Bethesda Mining does not have enough excess capacity at its existing mines to guarantee the contract. The company is considering opening a strip mine in Ohio on 5,000 acres of land purchased 10 years ago for $5 million. Based on a recent appraisal, the company feels it could receive $4.5 million on an aftertax basis if it sold the land today. Strip mining is a process where the layers of topsoil above vein are removed and the exposed soil is removed. Some time ago, the company would simply remove the coil and leave the land in an unusable condition. Changes in the mining regulations now force the a company to reclaim the land; that is, when mining is completed, the land must be restored to near its original condition. The land can then be used for other purposes. Because it is currently operating at full capacity, Bethesda will need to purchase additional necessary equipment, which will cost $30 million. The equipment will be depreciated on a seven-year MACRS schedule. The contract runs for only four years. At that time the coal from the site will be entirely mined. The company feels that the equipment can be sold for 60 percent of its initial purchase price. However, Bethesda plans to open another strip mine at that time and will use the equipment at the new mine. The contract calls for the delivery of 500,000 tons of coal per year at a price of $35 per ton. Bethesda Mining feels that call production will be 550,000 tons, 625,000 tons, 710,000 tons, and 640,000 tons, respectively, over the next four years. The excess production will be sold in the spot market at an average of $40 per ton. Variable costs amount to $10 per ton, and fixed costs are $2,500,000 per year. The mine will require a net working capital investment of 3 percent of sales. The NWC will be built up in the year prior to sales. Bethesda will be responsible for reclaiming the land at termination of the mining. This will occur in year 5. The company uses an outside company for reclamation of all the company's strip mines. It is estimated the cost of reclamation will be $3 million. After the land is reclaimed, the company plans to denote the land to the state for use as a public park and recreation area. This will occur in year 6 and result in a charitable expense deduction of $5 million. Bethesda faces a 40 percent tax rate and has a 10 percent required return on new strip mine projects. Assume that a loss in any year will result in a tax credit. You have been approached by the president of the company with a request to analyze the project. Calculate the payback period, profitability index, net present value and internal rate of return for the new strip mine. Should Bethesda Mining take thecontract and open the mine?

Mr. Veryser has served on the faculties of Northwood University, St. Mary’s College-Orchard Lake, Hillsdale College, Ave Maria College, the University of Detroit, and served as assistant to the president at Hillsdale College from 1974-78. He is also a businessman who owned an automotive supply company for many years. Mr. Veryser is an associate scholar of the Ludwig von Mises Institute and serves on the advisory boards of the Mackinac Center for Public Policy and the Acton Institute for the Study of Religion and Liberty. EnCana, a trans-national energy company headquartered in Alberta, fracked and contaminated the fresh water aquifers that supply the community with drinking water. The Insider has an ongoing lawsuit against the company, Alberta's energy regulator and Environment Ministry (www.ernstversusencana.ca). More clips from Nikiforuk's book launch tour to come.
